1. Acceptance of Terms

By downloading, installing, accessing, or using Nazel ("the Application" or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Application.

2. Description of Service

Nazel is a macOS application that enables users to download files, including torrent files and regular files, from the internet. The Application includes browser extensions for Safari and Chrome that facilitate downloading files through the Application.

3. Eligibility

You must be at least 13 years of age to use Nazel. By using the Application, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

4. User Responsibilities

4.1 Lawful Use

You agree to use Nazel only for lawful purposes and in accordance with these Terms. You are solely responsible for ensuring that any content you download complies with applicable laws, including copyright laws, intellectual property laws, and other regulations in your jurisdiction.

4.2 Content Responsibility

You acknowledge that Nazel is a tool for downloading files and that you are solely responsible for:

• The legality of files you download
• Ensuring you have the right to download and use any content
• Complying with all applicable laws and regulations regarding downloaded content
• Respecting intellectual property rights of content creators

4.3 System Requirements

You are responsible for ensuring your system meets the minimum requirements for Nazel, including macOS 13.0 or later, and that you have proper authorization to install and use the Application on your device.

5. Prohibited Uses

You agree NOT to use Nazel to:

• Download, distribute, or share copyrighted material without authorization
• Download or distribute illegal content, including but not limited to pirated software, movies, music, or other protected works
• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property rights of others
• Download content that contains malware, viruses, or other harmful code
• Use the Application in any way that could damage, disable, overburden, or impair our servers or networks
• Attempt to gain unauthorized access to any portion of the Application or any other systems or networks
• Use automated systems or scripts to abuse or exploit the Application

6. Intellectual Property

6.1 Application Ownership

Nazel, including its source code, design, functionality, and documentation, is protected by copyright and other intellectual property laws. All rights, title, and interest in and to the Application remain with the copyright owner.

6.2 License Grant

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to download, install, and use Nazel for your personal, non-commercial use on macOS devices.

6.3 Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the Application
• Reverse engineer, decompile, or disassemble the Application
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the Application for commercial purposes without explicit written permission

• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any content you download or distribute using the Application
• Your violation of any applicable law or regulation

10.1 Download Sources

Nazel enables you to download files from third-party sources. We do not control, endorse, or assume responsibility for any third-party content, websites, or services. Your interactions with third-party sources are solely between you and such third parties.

10.2 Torrent Networks

When using torrent functionality, you may connect to peer-to-peer networks. You acknowledge that:

• We do not control or monitor torrent networks or their content
• You are responsible for the legality of content you download via torrents
• You may be sharing files with other users on the network
• We are not responsible for the actions of other users on torrent networks

Your use of Nazel is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle information related to your use of the Application.

12. Updates and Modifications

12.1 Application Updates

We may provide updates, upgrades, or modifications to the Application. These updates may be provided automatically or require your action. You agree to receive such updates as part of your use of the Application.

12.2 Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date. Your continued use of the Application after such modifications constitutes your acceptance of the updated Terms.

13. Termination

13.1 Termination by You

You may stop using Nazel at any time by uninstalling the Application and removing browser extensions.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the Application at any time, with or without cause or notice, for any reason, including if you breach these Terms.

13.3 Effect of Termination

Upon termination, your right to use the Application will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Export Restrictions

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and trade and economic sanctions maintained by the U.S. Treasury Department's Office of Foreign Assets Control.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Application is developed, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Application shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiation, you agree to submit to the exclusive jurisdiction of the courts in the applicable jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nazel regarding the use of the Application and supersede all prior agreements and understandings, whether written or oral.

18. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

19. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms or any rights or obligations hereunder without restriction.
